From Alito's language in the majority opinion, he's set the stage or wrenching us back to the 18th Century. The language claims it's invalid because it wasn't in the original hand-written Constitution. Even if it's only interpreted to mean laws established before the 14th Amendment, that still puts us back 1868.

Alito has essentially vacated every liberal interpretation of constitutional law as not "deeply rooted in history."
